Introduction

Welcome to the terms and conditions that will apply to your use of the Prodokraft mobile application and marketplace e-commerce website, together known as the "Platform." Prodokraft E-Commerce Private Limited, a business formed under the Companies Act of 1956 and having its registered office at 257/Bilikana, Badachana, Jajpur, Odisha - 754296, is in charge of managing the platform. Prodokraft E-Commerce Private Limited is referred to as "Company," "Us," "We," and "Prodokraft" throughout these agreements.

By accessing or using the Platform, you declare that you have read, understood, and consent to these terms and conditions. Note that third-party products and services are subject to separate terms of service; please be aware of this. According to the Information Technology Act of 2000 and the regulations that go along with it, this document is an electronic record. Being created electronically, it does not require any digital or physical signatures.

Terms of Use

By using the Platform, you understand and consent to be bound by the terms and conditions stated here.We reserve the right, in our sole discretion, to modify these terms at any time. All of these terms and conditions make up a binding contract between Prodokraft and you, the "User." A "User" is anyone who accesses, browses, transacts, or uses services via the Platform. By accepting these terms, you also agree to abide by our privacy statement, guidelines, rules, and other relevant policies. It is imperative that you stop using the Platform if you disagree with these terms. Users under 18 are required to use the Platform under the supervision and with permission of their parents or guardians.

User Representations

In order to enter into contracts, users must be at least eighteen years old and legally capable. It is your responsibility to make sure the registration data you submit is true, correct, and comprehensive. We have the right to suspend or delete your account if we believe the information is untrue or incorrect. You bear the responsibility of ensuring the privacy of your account information and are accountable for any actions made using it. You are accountable for any unauthorised use of your account by outside parties. You may not try to decode, decompile, disassemble, hack, or reverse engineer any portion of the Platform, nor help others in doing so. You may only use the Platform for legitimate reasons.

Personal Data

In compliance with our privacy policy, Prodokraft will handle your personal data and sensitive personal information that it receives or provides to us. For more on how we manage your data, please see our Privacy Policy. As outlined in the Privacy Policy, you agree that your personal information may be collected, stored, processed, transferred, and shared by the Platform.

Representations and Warranties

We have established a grievance redressal mechanism with a designated grievance officer, Swaraj Samal, who will acknowledge complaints within 48 hours and resolve them within one month. We do not charge cancellation fees as an e-commerce organization unless we or our sellers incur comparable fees in the event that they cancel an order. We record customer consent for purchases through explicit and affirmative actions. Refund requests are processed by the Reserve Bank of India guidelines and other applicable laws.

We do not:

• Modify the cost of products or services in order to make an excessive profit.
• Treat users differently based on their class or create arbitrary classifications that have an impact on their rights.

User Restrictions

Users agree not to:

•  Upload, modify, or share harmful or illegal content.
•  Collect data from the Platform to create a database without permission.
•  Collect usernames or email addresses for unsolicited emails.
•  Use the Platform for unauthorized commercial activities.
•  Take part in unapproved framing or linking of the website.
•   Mislead or defraud us and other users.
•   Misuse support services or submit false abuse reports.
•   Interfere with the Platform's operations.
•   Impersonate another person or user.
•   Attempt unauthorized access to the Platform.
•   Violate any applicable laws.
•   Sell or transfer your account.
•   Harass, mistreat, or injure people with information obtained via the Platform.
•   Make illicit use of the Platform or encourage illicit activity.

Website Feedback & User Content:

We provide space on the Platform for users to leave reviews or ratings. Reviews must be based on firsthand experiences, free from offensive or discriminatory language, and not affiliated with competitors. It is not acceptable for users to make up campaigns to get others to write reviews or to publish inaccurate or misleading information.

Intellectual Property Rights

All content on the Platform, including source codes, software, audio, video, text, pictures, graphics, trademarks, etc, is owned by us unless otherwise indicated. Third-party trademarks appearing on the Platform are owned by their respective owners. Users must obtain permission from third party intellectual property owners for use. Users do not acquire any ownership rights to any intellectual property pertaining to the Platform under these conditions.

Term and Termination

Until you or we terminate them, these conditions are in effect. We may deny access to the Platform or terminate your account without notice for any reason, including breach of these terms or applicable laws. We may also take legal action, including civil, criminal, and injunctive actions, as necessary.

Advertisements

Third-party organizations are permitted to display advertisements on the Platform. Any issues related to advertisements must be addressed directly with the advertisers. We are not liable for any errors, omissions, or negligence by third-party advertisers. Our role is limited to providing space for advertisements.

Payment

The Platform accepts payments through Visa, Mastercard, Rupay, net banking, cash on delivery, and UPI. Users must provide accurate payment information and keep their account details updated.

Cash on Delivery

(A COD charge of INR 50 applies to all orders using COD. COD is not available for orders exceeding INR 20,000)

Cancellation Policy

Users can cancel orders within 24 hours of placement. The Refund Policy processes refunds for canceled orders and will be refunded within 7 - 10 business days. Users should not accept the delivery of canceled orders.

Return, Replacement & Refund Policy

Users can return products within the seller's specified timeframe. A picture of the product and packaging must accompany return requests. We will arrange a reverse pickup after the seller approves it. Only products meeting specific conditions, such as mismatched orders or damaged goods, qualify for returns. Fashion-related products can be replaced based on availability. Refunds are processed after receiving the seller's confirmation and initiated within ten business days.

Shipping Policy

We deliver across India through reliable logistics partners. Delivery timelines include 2 business days for packaging and 3-4 days for delivery post-pickup. Operations are active on business days except Sundays and national holidays. For delivery issues, contact us at help@prodokraft.com.

Indemnity

Users agree to indemnify Prodokraft and its affiliates against any losses, liabilities, claims, or expenses arising from their use of the Platform.

Liability

Prodokraft does not manufacture any listed products and serves as an intermediary marketplace. Users must direct claims regarding product quality to the sellers. Prodokraft is not liable for such claims.

Disclaimer

The Platform is provided on an "as-is" and "as-available" basis. All risks related to using the Platform are considered by the users. We disclaim all warranties and are not liable for any damages arising from the use of the Platform.

Dispute Resolution

Disputes are governed by Indian law, and the courts in Bhubaneswar, Odisha, have exclusive jurisdiction.
